SERVICE AGREEMENT & TERMS OF SERVICE

IMPORTANT NOTICE

These Service Agreement & Terms of Service ("Agreement", "Terms or "TOS") govern the products and services provided by Synsix Inc. ("Synsix", "we", "us" or "our").These Terms are intended to clearly establish the rights and responsibilities of Synsix and its customers while recognizing all rights and obligations imposed by applicable law. Nothing in these Terms is intended to waive, restrict, exclude or limit any right or remedy that cannot legally be waived, restricted, excluded or limited under applicable law. Customers should carefully review the applicable service-specific provisions before booking.

PART 1 — GENERAL TERMS & SERVICE POLICIES

1. AGREEMENT TO THESE TERMS

These Terms apply to all products, services, quotations, estimates, appointments, consultations, deliveries, installations, repairs, maintenance, cleaning, assembly, diagnostics, inspections, purchases and other services provided by Synsix. These Terms apply regardless of whether a transaction is initiated through: Synsix's website; online booking; telephone; email; text message; social media; WhatsApp; third-party booking platforms; electronic invoice; in person; or another communication method approved by Synsix. A customer may accept these Terms by signing an agreement, accepting an online booking, accepting a quotation, approving work electronically, paying an invoice or deposit, authorizing work to begin, or otherwise proceeding with the applicable transaction, to the extent permitted by applicable law. Where applicable consumer-protection legislation requires a particular form of agreement, disclosure, acceptance, delivery or cancellation right, those statutory requirements will apply.

2. CUSTOMER

"Customer" means the individual, business, corporation, property owner, tenant, landlord, condominium corporation, property manager, organization or authorized representative purchasing, requesting, approving or receiving Products or Services from Synsix. Where a person books or authorizes services on behalf of another person or organization, that person represents that they have the authority to do so. The Customer remains responsible for ensuring that Synsix has the necessary authorization to access the Property and perform the requested work.

3. SERVICES

Synsix services may include, without limitation: BBQ cleaning and maintenance; BBQ repairs; BBQ diagnostics; gas services; gas appliance installation and connection; White Glove BBQ services; BBQ sales; yard maintenance; yard clean-ups; junk removal; assembly services; PC assembly and building;consultations;inspections;delivery;maintenance;replacement-part installation; and other services offered by Synsix. The specific scope of each Service is determined by the applicable quotation, booking confirmation, invoice, service description or written agreement.

4. SERVICE AREA

Synsix determines the areas in which it offers each Service. Certain Services may not be available in every municipality or location. Travel charges may apply where a Property is outside Synsix's standard service area or requires unusual travel, access, transportation or logistical arrangements.

5. CUSTOMER INFORMATION

Customers must provide complete and accurate information reasonably required to quote, schedule and perform the Service. This may include: name; address; telephone number; email address; property information; BBQ brand and model; serial number; photographs; measurements; access information; building restrictions; parking information; utility information; existing damage; known hazards; and any other information relevant to the Service. If information supplied by the Customer is inaccurate, incomplete or materially misleading, Synsix may revise the quotation, modify the Service, reschedule the appointment or decline the Service. Additional costs caused by inaccurate or incomplete information may apply where permitted by law and where properly disclosed.

6. PHOTOGRAPHS FOR QUOTING

Customers are strongly encouraged to provide clear photographs or videos before requesting a quotation. Photographs may include: the equipment; BBQ; work area; access route; surrounding property; existing damage; installation location; serial number; stairs; elevators; parking conditions; yard conditions; junk to be removed; or other relevant areas. Providing photographs can significantly improve pricing accuracy and speed up the quotation process. For BBQ quotations, photographs may be texted to 647-861-3888 for faster quoting. Photographs do not guarantee final pricing where material conditions cannot reasonably be determined remotely.

7. SERIAL NUMBERS

Where applicable, Customers may be required to provide a product or appliance serial number. Serial numbers may be located in different areas depending on the manufacturer and model, including: rear of the unit; inside cabinet doors; underneath the appliance; underneath or behind the drip tray; inside access panels; or on manufacturer identification labels. Failure to provide an available serial number may affect parts identification, warranty verification, quotation accuracy or scheduling.

8. QUOTATIONS & ESTIMATES

Unless expressly identified in writing as a fixed-price quotation, prices provided by Synsix are estimates based on the information reasonably available at the time. Estimates may be revised where: actual conditions materially differ from information provided; additional labour is required; additional materials are required; hidden damage is discovered; parts are required; access conditions differ; safety issues are identified; additional work is requested; or the scope of work changes .Synsix will communicate material additional charges before proceeding where reasonably practicable and where Customer authorization is required by law. A quotation does not include work that is not expressly identified in the quotation. Written quotations are generally valid for 30 days unless another validity period is stated.

9. ADDITIONAL WORK

Work outside the agreed scope constitutes additional work. Additional work may include: additional labour; additional technician visits; parts; materials; repairs; disposal; parking; permits; gas work; additional cleaning ;or other services requested or required after the original scope is established. Synsix will obtain Customer approval for additional work where required, except where immediate action is reasonably necessary to address a safety issue, protect property or comply with applicable law or regulatory requirements.

10. SERVICE DURATION

All service durations provided by Synsix are estimates. Actual service times may vary based on: equipment condition; size; model; manufacturer; accessibility; complexity; weather; previous repairs; hidden conditions; required parts; site conditions; customer requests; and other circumstances. Synsix does not guarantee a specific completion time unless expressly confirmed in writing.

PART 2 — BOOKINGS, SCHEDULING & ARRIVAL WINDOWS

11. STANDARD APPOINTMENTS

Synsix normally books appointments using an open arrival window, rather than a guaranteed specific appointment time. Current standard arrival windows are: 9:00 AM – 12:00 PM, 11:00 AM – 2:00 PM, 1:00 PM – 4:00 PM, 3:00 PM – 6:00 PM. Customers may request a preferred window. Synsix will make reasonable efforts to accommodate the Customer's preferred window, but a preferred standard window is not guaranteed unless Synsix expressly confirms a Reserved Time Appointment.

12. ROUTE OPTIMIZATION

Synsix operates a route-based scheduling system designed to efficiently move technicians between appointments. The day before an appointment, Synsix generally maps and organizes the following day's routes based on the most efficient and practical route between scheduled appointments. Route planning may consider: geographic location; travel time; technician availability; equipment requirements; service duration; service complexity; traffic; road conditions; customer access requirements; weather; previous appointments; and operational requirements. This system allows Synsix to reduce unnecessary travel, improve efficiency and serve more customers. Because routes are finalized based on the overall schedule, Customers cannot require a particular arrival time as part of a standard appointment.

13. ARRIVAL WINDOW CONFIRMATION

Customers will generally receive an appointment reminder and updated arrival window by email and/or text message. The final route may not be determined until the day before the appointment. Arrival times may change due to: traffic; weather; previous appointments taking longer than anticipated; emergencies; equipment issues; vehicle issues; customer access issues; road closures; service complexity; or other circumstances outside Synsix's reasonable control. Synsix will make reasonable efforts to communicate significant changes.

14. RESERVED TIME APPOINTMENTS

Customers who require a particular time or narrower arrival period may request a Reserved Time Appointment. A $40.00 + applicable taxes Time Reservation Fee will apply. A Reserved Time Appointment is subject to technician availability and must be expressly confirmed by Synsix. The reservation fee compensates Synsix for modifying its normal route-planning system and reserving technician availability around the requested time. A Reserved Time Appointment does not guarantee that the Service itself can be completed if: the Property is inaccessible; required utilities are unavailable; the work area is unsafe; the equipment cannot reasonably be serviced; weather prevents safe completion; conditions materially differ from those disclosed; or another circumstance outside Synsix's reasonable control prevents completion. Where the Customer causes a Reserved Time Appointment to be unsuccessful, applicable call-out or other charges may apply.

15. WEEKEND APPOINTMENTS

Weekends are generally reserved for: rush services; weather-related rescheduling; appointments displaced by operational disruptions; priority services; or other appointments specifically approved by Synsix. Weekend appointments are not part of Synsix's standard scheduling availability. Where weekend service is available, a $50.00 + applicable taxes Weekend Reservation Fee applies. Weekend availability is limited and must be confirmed by Synsix. The Weekend Reservation Fee is separate from any Rush Service Fee.

16. RUSH SERVICE

Where availability permits, Synsix may offer Rush Service. Rush Service requires Synsix to prioritize the Customer's appointment ahead of ordinary scheduling availability and may require: overtime; double technician pay; technician schedule changes; extended hours; additional travel; weekend work; or other operational accommodations. Rush fees generally range from $50.00 to $500.00 + applicable taxes, depending on the requested date, availability, staffing, travel and service requirements. Rush Service is subject to availability. A Reserved Time Fee, Weekend Reservation Fee and Rush Service Fee may apply together where the Customer requests all applicable services and Synsix confirms them.

17. NO GUARANTEE OF EXACT ARRIVAL TIME

Except where a Reserved Time Appointment has been expressly confirmed, Synsix does not guarantee an exact arrival time. Even a Reserved Time Appointment may need to be delayed, rescheduled or modified due to circumstances outside Synsix's reasonable control. Synsix will make reasonable efforts to communicate material delays.

18. CUSTOMER TIME COMMITMENTS

Customers are strongly advised not to schedule time away from work or make other time-sensitive commitments based solely on a standard arrival window. Synsix is not responsible, to the extent permitted by law, for losses arising from a Customer choosing to remain available for a standard appointment, including: lost wages; missed meetings; childcare expenses; travel changes; contractor coordination costs; accommodation costs; lost business opportunities; or other consequential losses. Customers with strict time requirements should request a Reserved Time Appointment.

PART 3 — PROPERTY ACCESS, WORK CONDITIONS & SAFETY

19. PROPERTY ACCESS

The Customer is responsible for ensuring that Synsix has safe, legal and reasonably unobstructed access to the Property and Work Area. The Customer must arrange, where applicable: unlocked gates; gate codes; concierge access; elevator reservations; loading dock access; parking; security clearance; building approvals; property-management approval; and other access requirements. Failure to provide access may result in rescheduling or applicable charges.

20. CUSTOMER PRESENCE

Unless otherwise agreed, the Customer or an authorized representative should be available during the appointment. Where the Customer authorizes Synsix to complete the Service while the Customer is absent, the Customer authorizes Synsix to access the Property and complete the approved scope of work. The Customer remains responsible for ensuring that such access is lawful and authorized.

21. WORK AREA

Customers must provide a reasonably safe and suitable area for the requested Service. The Customer must remove or secure items that could interfere with the Service, including where applicable: furniture; toys; garden hoses; decorations; vehicles; electrical cords personal belongings; sports equipment; pets; or other obstructions. Synsix may decline, modify or postpone a Service where the Work Area cannot reasonably be made safe or accessible.

22. WATER, ELECTRICAL & UTILITY ACCESS

Where required for a Service, the Customer must provide access to: a functioning outdoor water tap suitable for hose connection; an electrical outlet; active gas service where operational testing is required; and other utilities reasonably required for the contracted Service. If required utilities are unavailable, inaccessible, frozen, disconnected, shut off or otherwise unusable, Synsix may: perform a modified Service; perform dry cleaning where applicable; postpone the Service; reschedule the Service; or decline the Service. Modified services may not produce the same results as the standard Service and may have different costs associated with each modified service.

23. SAFETY

The safety of Customers, employees, technicians, contractors, property and the public takes priority over completion of a requested Service. Synsix may suspend, modify, postpone or refuse a Service where conditions are unsafe. Unsafe conditions may include: aggressive animals; biohazards; rodent infestations; insects or nests; unsafe structures; unsafe electrical conditions; unsafe gas conditions; severe weather; excessive heat; freezing temperatures; ice; unstable decks or balconies; structural instability; hazardous contamination; violence; threats; illegal activity; or other conditions presenting a reasonable health or safety concern. Synsix may stop work immediately if unsafe conditions develop.

24. WEATHER

Outdoor Services may be postponed, rescheduled or modified due to weather or environmental conditions. Conditions may include: rain; thunderstorms; lightning; snow; freezing temperatures; ice; excessive heat; high winds; smoke; poor air quality; wildfire conditions; flooding; or severe weather warnings. Synsix will make reasonable efforts to reschedule affected appointments. Customers should not rely on an outdoor appointment remaining available in adverse weather.

25. EVENTS OUTSIDE SYNSIX'S REASONABLE CONTROL

Synsix will not be responsible for delays or inability to perform caused by circumstances outside its reasonable control, including: severe weather; natural disasters; fire; flooding; utility failures; road closures; transportation disruptions; government restrictions; public emergencies; labour disruptions; supplier delays; equipment failures; vehicle failures; emergencies; or other circumstances materially affecting safe or reasonable performance. Synsix will make reasonable efforts to reschedule affected Services.

PART 4 — CALL-OUTS, CANCELLATIONS & RESCHEDULING

26. CALL-OUT FEE

Unless otherwise stated in writing, a $50.00 + applicable taxes Call-Out Fee may apply where Synsix attends the Property but cannot reasonably perform the scheduled Service due to circumstances attributable to the Customer or circumstances outside Synsix's reasonable control. Examples include: blocked access; no one available where access is required; locked gates; unavailable utilities; unsafe conditions; inaccessible equipment; inaccurate information; unsecured animals; required approvals not obtained; unprepared equipment; incomplete site preparation; or conditions materially different from those disclosed. The Call-Out Fee compensates Synsix for technician travel, scheduling, vehicle and appointment-allocation costs. The Call-Out Fee does not guarantee priority rescheduling. The Call-Out Fee will not apply where Synsix is solely responsible for the inability to perform the Service.

27. CUSTOMER CANCELLATIONS

Customers should provide as much notice as reasonably possible when cancelling. Where permitted by applicable law and properly disclosed before booking, cancellation charges may apply where Synsix has incurred costs or reserved resources for the Customer. Such costs may include: specially ordered Products; non-returnable materials; scheduled technicians; permits; delivery arrangements; third-party charges; or other documented costs. Nothing in this Section limits any statutory cancellation or refund right available to the Customer.

28. RESCHEDULING

Customers may request to reschedule an appointment subject to availability. Synsix may reschedule appointments due to: weather; unsafe conditions; employee illness; emergencies; equipment failure; supplier delays; traffic; route changes; or circumstances outside Synsix's reasonable control. Where Synsix reschedules an appointment, it will make reasonable efforts to provide another available appointment. Weather-related rescheduling may require the use of weekends where available.

29. STATUTORY CANCELLATION RIGHTS

Nothing in these Terms removes or limits any cancellation, rescission, refund or other right that a Customer has under applicable consumer-protection legislation. Where a transaction is subject to statutory requirements for an internet agreement, remote agreement, direct agreement or other regulated consumer transaction, Synsix will comply with the applicable disclosure, agreement-copy and cancellation requirements. Where required, the Customer will receive a copy of the applicable agreement in a form that can be retained.

30. ONLINE & REMOTE BOOKINGS

Where a Customer enters into an agreement electronically or remotely and applicable law imposes specific requirements, Synsix will provide the required disclosures and obtain the required acceptance. Where applicable, the Customer will have an opportunity to: review the agreement; accept or decline the agreement; correct errors before acceptance; and retain a copy of the applicable agreement. The applicable booking confirmation, quotation, invoice and service-specific terms may form part of the agreement.

PART 5 — PAYMENT, DEPOSITS & ADDITIONAL CHARGES

31. PAYMENT

Unless otherwise agreed in writing, payment is due upon completion of the Service. Synsix may require payment before: ordering Products; ordering special parts; reserving inventory; scheduling large projects ;arranging delivery ;commencing custom work; reserving appointment time slots; or beginning certain Services. Commercial accounts may be subject to separate invoice terms.

32. PAYMENT METHODS

Synsix may accept: debit card; credit card; electronic transfer; e-transfer where approved; or other payment methods expressly approved by Synsix. Synsix may change accepted payment methods from time to time.

33. CREDIT CARD SURCHARGES

Where Synsix applies a credit-card surcharge, the surcharge will be separately disclosed before payment and will be subject to applicable law and payment-card-network rules. Any applicable surcharge will not exceed the amount permitted by applicable law or payment-card-network requirements. Customers will be provided with the applicable surcharge information before completing the transaction. Synsix will not automatically apply a credit-card surcharge where doing so would exceed an applicable legal or network limit.

34. DEPOSITS

Certain Services may require a deposit. Deposits may be required for: special-order Products; custom work; large projects; commercial projects; Product purchases; delivery; installation; or reserved scheduling. Where permitted by law and properly disclosed, a deposit may be applied toward: Products; materials; labour; scheduling; delivery; or other agreed costs. Cancellation and refund treatment of deposits is subject to applicable law and the specific agreement governing the transaction.

35. ADDITIONAL CHARGES

Unless expressly included in the quotation, reasonable and applicable additional charges may include: parts; materials; additional labour; parking; parking permits; building fees; elevator fees; disposal fees; dump fees; bin rentals; soil; mulch; aggregates; permits; tolls; equipment rentals; additional technician visits; emergency services; and Customer-requested additional work. Material additional charges will be communicated before proceeding where reasonably practicable and where Customer authorization is required by law.

36. LATE PAYMENTS

Commercial or otherwise approved invoiced accounts are due according to the payment terms stated on the applicable invoice or agreement. Where permitted by applicable law, overdue invoices may be subject to: a $50.00 administrative late fee after 30 days; and interest of 3% per month, or the maximum amount permitted by applicable law, whichever is lower. Synsix may suspend future non-emergency services for overdue accounts.

37. COLLECTIONS

Where permitted by law, overdue accounts may be referred to a collection agency or legal counsel. Synsix may seek recovery of reasonable collection costs and enforcement expenses to the extent permitted by applicable law.

38. CHARGEBACKS & PAYMENT DISPUTES

Customers are encouraged to contact Synsix promptly regarding billing concerns so that the issue can be investigated. A chargeback does not automatically cancel the Customer's underlying payment obligation. Synsix may provide relevant documentation to a payment processor, financial institution, collection agency, insurer, regulator or court, where appropriate. Documentation may include: invoices; quotations; booking records; customer approvals; photographs; technician notes; text messages; emails; service records; GPS records; payment records; and other relevant evidence. Nothing in this Section restricts any legal right a Customer may have to dispute a transaction.

PART 6 — GENERAL SERVICE CONDITIONS & CUSTOMER RESPONSIBILITIES

39. CUSTOMER-SUPPLIED PRODUCTS & MATERIALS

Where the Customer supplies a Product, replacement part, material, equipment or component, Synsix does not guarantee: compatibility; quality; completeness; manufacturer condition; dimensions; performance; or suitability. If a Customer-supplied component is defective, incompatible, incomplete or incorrect, additional labour or return-visit charges may apply where properly disclosed. Synsix is not responsible for manufacturer defects in Customer-supplied Products.

40. PRE-EXISTING CONDITIONS

Synsix is not responsible for conditions that existed before the Service, except to the extent liability arises from Synsix's negligence or another legal obligation. Pre-existing conditions may include: rust; corrosion; deterioration; cracked components; broken welds or parts; warped materials; defective parts; missing hardware; missing components; improper prior repairs or assembly; hidden damage; existing electrical issues; existing gas deficiencies; existing landscaping defects; structural deficiencies; or other pre-existing conditions. Service may reveal conditions that were not visible before work began. The discovery of a condition during Service does not, by itself, establish that Synsix caused the condition.

41. HIDDEN CONDITIONS

Certain defects cannot reasonably be identified before equipment or property is opened, moved, cleaned, disassembled or inspected. Hidden conditions may include: concealed corrosion; seized hardware; internal damage; underground utilities; concealed wiring; concealed gas piping; structural deterioration; water damage; electrical failures; or other conditions not reasonably visible. Where hidden conditions materially affect the Service, Synsix may recommend additional work, revise the quotation, modify the Service or stop work.

42. SEIZED HARDWARE

Outdoor equipment may contain fasteners or components seized by corrosion, heat, age or environmental exposure. When removing seized components, hardware may: break; strip; shear; become unusable; or require replacement. Synsix will exercise reasonable care when attempting removal. Where failure occurs due to an existing seized or deteriorated condition, additional labour or replacement costs may apply where permitted and properly disclosed.

43. RIGHT TO REFUSE OR STOP SERVICE

Synsix may refuse, suspend or stop a Service where, in its reasonable judgment: conditions are unsafe; illegal activity is occurring; required utilities are unavailable; access is unavailable; requested work violates applicable law; required approvals are absent; hazardous materials are present; the Customer or another person is threatening or abusive; the requested work falls outside Synsix's scope; or continuing would expose people or property to unreasonable risk. Where work is stopped because of conditions attributable to the Customer or outside Synsix's reasonable control, applicable charges may apply.

44. CUSTOMER CONDUCT

Synsix is committed to maintaining a safe and respectful workplace. Threats, harassment, violence, intimidation, discrimination, abusive conduct or interference with technicians will not be tolerated. Where inappropriate or unsafe conduct occurs, Synsix may: suspend work; leave the Property; cancel the appointment; refuse future service; and charge applicable amounts for work performed or costs incurred, subject to applicable law.

45. CUSTOMER PROPERTY

Customers are responsible for identifying and protecting fragile, valuable or sensitive property in or near the Work Area. Synsix will exercise reasonable care. However, Synsix is not responsible for damage to property that is: already damaged; defective; unstable; unusually fragile; concealed; improperly installed; not reasonably visible; or not disclosed as requiring special handling, except to the extent liability arises from Synsix's negligence or other applicable legal obligation.

46. CUSTOMER APPROVAL OF ADDITIONAL WORK

Customer approval may be provided through: signature; electronic signature; email; text message; electronic invoice approval; online booking; or another documented communication clearly authorizing the work. Where applicable law requires a specific form of authorization, Synsix will follow that requirement.

PART 7 — WARRANTIES, LIABILITY & LEGAL TERMS

47. WORKMANSHIP

Unless otherwise stated in writing, Synsix's service warranty applies only to workmanship directly performed by Synsix and only to the extent required or provided under the applicable written warranty. A workmanship warranty does not guarantee: future performance; future appliance operation; future cleanliness; future appearance; manufacturer performance; normal wear; corrosion; weather deterioration; Customer misuse; unauthorized modifications; or unrelated component failures.

48. MANUFACTURER WARRANTIES

Manufacturer warranties remain subject to the manufacturer's terms. Synsix does not replace or expand a manufacturer's warranty. Synsix may assist Customers with manufacturer warranty claims where reasonably practicable.

49. SYNSIX WARRANTY CLAIM PROCESS

Customers must notify Synsix promptly after discovering, or reasonably becoming aware of, any alleged defect, damage, malfunction, or workmanship issue relating to services performed by Synsix.

Where the issue involves a product, appliance, BBQ, assembly, repair, installation, gas service, or other equipment that can reasonably be left unused, the Customer should not use, operate, alter, disassemble, move, modify, or permit another person or contractor to work on the affected product or area after discovering the alleged issue, except where reasonably necessary to address an immediate safety concern or prevent further damage.

Where reasonably possible, Customers should notify Synsix before the affected product or equipment is used after the alleged issue is discovered. Continued use may change the condition of the product, create additional damage, affect the ability to determine the original cause of the issue, or make it difficult to establish whether the condition resulted from Synsix's workmanship, a pre-existing condition, normal wear, misuse, subsequent use, or another cause.

Customers should provide Synsix with sufficient information to investigate the concern, which may include:

  • Photographs and/or videos clearly showing the alleged issue;

  • A written description of what occurred and when it was first noticed;

  • The applicable invoice, quotation, or service information;

  • The date the service was performed;

  • The date and circumstances in which the issue was discovered;

  • Relevant manufacturer, warranty, inspection, or repair documentation;

  • Information regarding any use of the product or equipment after Synsix's service;

  • Information regarding any previous repairs, modifications, damage, or known issues; and

  • Reasonable access to the affected product, equipment, property, or work area for inspection.

Synsix must be provided with a reasonable opportunity to inspect the affected work and determine the cause of the reported issue before the Customer, another contractor, technician, manufacturer, or other third party alters, repairs, replaces, disassembles, modifies, or otherwise interferes with the affected work.

If the Customer proceeds with repairs, alterations, replacement, disassembly, or other work by a third party before Synsix has been given a reasonable opportunity to inspect the issue, Synsix may be unable to determine the original cause of the issue or whether it resulted from Synsix's workmanship. This may materially affect Synsix's ability to assess, reproduce, verify, or remedy the alleged workmanship issue.

Where an affected product has been used after the alleged issue was discovered, Synsix may require additional information, inspection, testing, or documentation to determine whether the reported condition existed immediately following Synsix's service or arose, changed, or was aggravated through subsequent use, operation, maintenance, modification, damage, or other circumstances outside Synsix's control.

Nothing in this Section constitutes a guarantee that Synsix will accept responsibility for an alleged issue, nor does the reporting of an issue itself constitute an admission of fault or liability by Synsix. Synsix will assess each reported issue based on the available evidence, the condition of the product or work, the circumstances surrounding the service, applicable manufacturer requirements, and any other relevant information.

Where Synsix determines that an issue resulted from Synsix's workmanship and that Synsix is responsible for remedying the issue, Synsix will work with the Customer to determine an appropriate remedy in accordance with the applicable service terms, any applicable warranty, and applicable law.

Customers are responsible for taking reasonable steps to prevent further damage after discovering an issue. Where an issue presents an immediate safety risk, the Customer should discontinue use of the affected equipment and take reasonable emergency measures to protect people and property. For gas appliances or equipment, Customers should not attempt to diagnose, repair, modify, or reconnect gas components themselves and should follow applicable safety requirements.

Nothing in this Section limits or excludes any statutory warranty, consumer protection right, remedy, or other right that cannot lawfully be excluded, restricted, or waived under applicable law.

50. NO GUARANTEE OF FUTURE PERFORMANCE

Synsix cannot guarantee the future: condition; lifespan; appearance; reliability; efficiency; cleanliness; safety; or performance of Customer-owned equipment, BBQs, gas appliances, landscaping, plants, Products or replacement components. Future performance depends on factors including: usage; maintenance; age; weather; environment; manufacturer design; normal wear; and circumstances outside Synsix's control.

51. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Synsix will not be responsible for losses caused by: pre-existing conditions; manufacturer defects; normal wear and tear; corrosion; weather; Customer misuse; unauthorized modifications; Customer-supplied defective or incorrect materials; hidden conditions; third-party actions; supplier delays; utility failures; conditions outside Synsix's reasonable control; or failure to maintain equipment after Service. To the maximum extent permitted by applicable law, Synsix will not be liable for indirect, incidental, special or consequential losses. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Where a limitation of liability is legally enforceable, Synsix's liability may be limited to the amount paid for the specific Service or Product giving rise to the claim, unless otherwise required by law.

52. NO WAIVER OF STATUTORY RIGHTS

Nothing in this Agreement is intended to: waive statutory rights; restrict mandatory consumer protections; eliminate legally required warranties; prevent lawful cancellation; exclude mandatory remedies; or limit liability that cannot legally be limited. If any provision conflicts with mandatory law, the applicable law will prevail to the extent of the conflict.

53. SERVICE DOCUMENTATION

Synsix may create and retain service records including: photographs; videos; technician notes; service checklists; serial numbers; quotations; invoices; Customer approvals; gas testing records; parts records; appointment records; communications; and payment records. These records may be used for: quality assurance; warranty administration; insurance matters; accounting; regulatory compliance; dispute resolution; chargeback responses; legal proceedings; and internal business purposes.

54. PHOTOGRAPHIC DOCUMENTATION

Synsix may photograph and/or record the Property, equipment, work area, products, components, installations, connections, and completed work before, during, and after providing services. Photographic and video documentation is an important part of Synsix's service, quality-control, safety, training, warranty, dispute-resolution, and record-keeping processes.

Documentation may include, but is not limited to:

  • Existing damage, scratches, dents, corrosion, rust, staining, discoloration, wear, deterioration, or other pre-existing conditions;

  • The condition of the equipment, appliance, BBQ, yard, property, work area, or items being serviced;

  • Existing defects, damage, improper installation, modifications, deterioration, or conditions that may affect the service;

  • Serial numbers, model numbers, identification labels, and other equipment information;

  • Gas lines, gas connections, valves, regulators, fittings, quick connects, appliances, and other gas-related components;

  • Electrical connections, wiring, plugs, outlets, switches, controls, and other relevant components;

  • Components removed, replaced, repaired, or identified as requiring replacement;

  • Grease, carbon buildup, debris, corrosion, rodent activity, nests, blockages, vegetation, waste, or other conditions relevant to the service;

  • Safety hazards, accessibility issues, working conditions, or conditions that may prevent or restrict the service;

  • The condition of the Property or surrounding areas before work begins;

  • The work performed by Synsix, including work in progress where appropriate;

  • Completed work and the condition of the equipment or work area following the service;

  • Parts, materials, products, or equipment supplied or installed by Synsix;

  • Any issues, deficiencies, limitations, or conditions communicated to the Customer;

  • Evidence relevant to a warranty claim, service complaint, damage allegation, insurance matter, manufacturer inquiry, or dispute; and

  • Other information reasonably necessary to document the service and protect the legitimate business interests of Synsix and the Customer.

By booking or authorizing services, the Customer acknowledges that photographic and/or video documentation may be taken as part of the service process.

Customers are expected to permit reasonable photographic documentation of the equipment, work area, Property areas directly relevant to the service, and completed work. Synsix will make reasonable efforts to limit photographs to areas and items relevant to the services being performed and will avoid intentionally photographing individuals or unrelated private information where reasonably practicable.

Where reasonably possible, Synsix may take photographs before commencing work to establish the condition of the equipment, Property, work area, and surrounding areas. Additional photographs may be taken during and after the service to document the work performed and the resulting condition.

If a Customer refuses to permit reasonable photographic or video documentation that Synsix considers necessary to safely perform, document, verify, or protect itself in connection with the services, Synsix may, at its discretion:

  1. Decline to commence the service;

  2. Pause or discontinue the service;

  3. Require the Customer to provide written acknowledgement of the refusal;

  4. Require additional documentation, inspection, or authorization before proceeding;

  5. Reschedule the service subject to applicable scheduling policies; or

  6. Determine that the requested service cannot reasonably be provided without appropriate documentation.

Where Synsix attends the Property and is unable to perform or complete the service because the Customer refuses documentation that Synsix reasonably requires, any applicable call-out, cancellation, rescheduling, or other service charges may apply in accordance with these Terms of Service and applicable law.

Photographic documentation is particularly important where a service involves an existing product, appliance, BBQ, structure, Property, installation, repair, cleaning, assembly, maintenance, or other work where conditions may change after Synsix leaves the Property.

If a Customer refuses reasonable photographic documentation, Synsix may have limited or no independent evidence of:

  • The condition of the equipment or Property before the service;

  • Existing damage or defects;

  • The condition of components before they were removed, cleaned, repaired, or replaced;

  • The condition of gas, electrical, plumbing, structural, or other connections before work;

  • The condition of the work area before Synsix arrived;

  • The work actually performed;

  • The condition of the equipment or Property when Synsix completed the service; or

  • Whether an alleged condition existed before, during, or after Synsix's service.

Accordingly, where a Customer has refused reasonable documentation, the Customer acknowledges that Synsix may be unable to independently verify the condition of the equipment or Property before or after the service.

A refusal to permit documentation does not automatically establish that Synsix is responsible for any subsequent damage, defect, malfunction, loss, or alleged workmanship issue. Any claim will be assessed based on the evidence reasonably available, including photographs, videos, service records, technician notes, Customer-provided documentation, manufacturer information, inspection findings, and other relevant evidence.

Where a Customer subsequently alleges that damage, a defect, or a workmanship issue existed immediately before or after Synsix's service, but photographic documentation was refused, Synsix may have limited ability to verify the Customer's allegation or determine whether the condition was pre-existing, caused by Synsix, caused by subsequent use, caused by another party, or resulted from another circumstance outside Synsix's control.

Nothing in this Section creates an automatic presumption of liability against either party, and nothing limits any statutory right, warranty, remedy, or protection that cannot legally be excluded or restricted.

Where Synsix requests photographs, videos, serial numbers, model information, measurements, or other information before attending a Property, the Customer is responsible for providing information that is reasonably accurate and representative of the actual conditions.

Quotes, service recommendations, scheduling decisions, and assessments based on Customer-provided photographs or information may be revised if the actual conditions differ materially from the information provided.

The Customer must not intentionally conceal, omit, alter, manipulate, crop, or otherwise misrepresent photographs or information provided to Synsix for the purpose of obtaining a quote, booking a service, or determining the scope of work.

Photographs and videos collected by Synsix will be used only for legitimate business purposes, which may include service documentation, quality control, technician records, training, customer service, warranty administration, dispute resolution, insurance matters, manufacturer communications, legal or regulatory purposes, and protection of Synsix's legitimate business interests.

Where appropriate and subject to applicable law and Synsix's Privacy Policy, documentation may be retained as part of the Customer's service record.

Synsix will make reasonable efforts to avoid unnecessarily capturing individuals, personal information, unrelated private areas, or unrelated property. Customers may advise the technician of reasonable privacy concerns before work begins so that reasonable measures can be considered without compromising necessary service documentation.

Where photographs or videos are intended to be used for public marketing, advertising, social media, website content, or other promotional purposes beyond ordinary service documentation, Synsix will obtain any consent required by applicable law before using identifiable individuals or other information requiring such consent.

Photographs and videos may form part of Synsix's official service record together with technician notes, inspection findings, invoices, quotations, communications, serial numbers, service dates, parts information, and other documentation.

Customers acknowledge that these records may be relied upon by Synsix when responding to complaints, warranty claims, damage allegations, insurance matters, manufacturer inquiries, regulatory inquiries, or disputes concerning the services provided.

Nothing in this Section prevents a Customer from exercising any statutory consumer, privacy, warranty, or other legal right that cannot lawfully be waived or restricted.

55. MARKETING PHOTOGRAPHY & VIDEO

Marketing use of photographs or videos is optional and is not a condition of receiving Services. Where Synsix wishes to use identifiable customer property, individuals or other identifying information for marketing purposes, appropriate consent will be obtained. Synsix may use non-identifying photographs of equipment or completed work where legally permitted and where the images do not reasonably identify the Customer or reveal personal information. Customers may withdraw marketing consent for future use by contacting Synsix.

56. PRIVACY

Synsix collects, uses, stores and discloses personal information in accordance with applicable privacy legislation and Synsix's Privacy Policy. Personal information may be used where reasonably necessary to: provide Services; communicate with Customers; process payments; schedule appointments; administer warranties; maintain service records; resolve disputes; comply with legal obligations; or operate the business.

57. ELECTRONIC COMMUNICATIONS

Customers consent, where permitted by law, to receiving service-related communications by: email; telephone; SMS/text message; electronic invoice; electronic booking system; or customer portal. Customers are responsible for providing accurate contact information. Marketing communications, where applicable, are subject to applicable consent and electronic-marketing laws.

58. THIRD-PARTY PRODUCTS & SERVICES

Synsix may work with or recommend manufacturers, suppliers, retailers, subcontractors, licensed tradespersons or other third parties. Synsix does not guarantee the performance of third-party products or services unless expressly agreed in writing. Where a third party is responsible for a manufacturer warranty, shipping issue, supplier delay or other third-party obligation, Synsix may assist the Customer where reasonably practicable but is not responsible for the third party's independent obligations.

59. SUBCONTRACTORS

Synsix may engage qualified employees, subcontractors, licensed tradespersons or specialists where appropriate. Where regulated work requires licensing or certification, the work will be performed by appropriately qualified persons as required by applicable law.

60. CUSTOMER INDEMNIFICATION

To the maximum extent permitted by law, the Customer agrees to be responsible for claims, losses or costs arising from: the Customer's unauthorized disposal of another person's property; inaccurate information supplied by the Customer; failure to disclose known hazards; unauthorized access instructions; Customer modifications to Synsix's work; or Customer conduct that directly causes loss or damage. This Section does not require the Customer to indemnify Synsix for Synsix's own negligence or liability where such indemnification is prohibited by law.

61. DISPUTE RESOLUTION

Customers should first notify Synsix within 48 hours or before first use of any concern so the Company has a reasonable opportunity to investigate and respond. Synsix will make reasonable efforts to resolve disputes in good faith. Nothing in this Section prevents a Customer from exercising any statutory right or legal remedy.

62. GOVERNING LAW

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

63. JURISDICTION

Subject to mandatory law and any applicable statutory forum or remedy, legal proceedings relating to this Agreement shall be brought in Ontario.

64. SEVERABILITY

If any provision of this Agreement is found to be invalid, illegal or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally permitted.

65. NO WAIVER

Failure by Synsix to enforce any provision of this Agreement does not constitute a waiver of that provision or any future right to enforce it. Any waiver by Synsix must be authorized by Synsix.

66. ASSIGNMENT

The Customer may not assign this Agreement without Synsix's consent where such consent is legally required. Synsix may assign or subcontract portions of its obligations where appropriate and permitted by law.

67. ENTIRE AGREEMENT

This Agreement, together with the applicable quotation, invoice, booking confirmation, Statement of Work and service-specific schedule, constitutes the agreement between Synsix and the Customer concerning the applicable transaction. Marketing materials, advertisements and general service descriptions do not create additional contractual obligations unless expressly incorporated into the applicable agreement.

68. ORDER OF PRECEDENCE

Where multiple documents apply to the same transaction, the following order generally applies: Applicable law; A written amendment expressly accepted by both parties; The applicable quotation or Statement of Work; The applicable service-specific terms; These general Terms; General marketing or promotional material. No document may override a mandatory legal requirement.

69. AMENDMENTS TO THESE TERMS

Synsix may update these Terms from time to time. The version applicable to a particular transaction will generally be the version provided to or accepted by the Customer when the transaction is entered into, unless otherwise permitted by law or expressly agreed. Changes to the Terms of service will not automatically alter a completed transaction.

70. SURVIVAL

Provisions that by their nature should survive completion, cancellation or termination will continue to apply, including provisions concerning: payment; warranties; liability; privacy; dispute resolution; records; intellectual property where applicable; and governing law.

PART 8 — SERVICE-SPECIFIC TERMS & SCHEDULES

SCHEDULE A — BBQ CLEANING & MAINTENANCE

A1. Scope

BBQ cleaning is a maintenance service intended to remove grease, feces, nests, food residue and debris from reasonably accessible areas. BBQ cleaning is not: restoration; refurbishment; rebuilding; structural repair; cosmetic restoration; repainting; welding; fabrication; gas modification; or certification of the appliance.

A2. BBQ Service Duration

BBQ cleaning may take approximately 45 minutes to 4 hours, depending on: brand; model; size; number of burners; condition; grease accumulation; carbon buildup; accessibility; cleaning type; work conditions; and other factors. A typical BBQ cleaning generally takes approximately 1.5 hours. No specific completion time is guaranteed.

A3. Two-Person Crew

Synsix may dispatch a two-person crew for BBQ cleaning and maintenance. Crew size may vary based on scheduling, service requirements, safety and operational needs.

A4. BBQ Work Area

Customers must provide an appropriate area for technicians to safely access and clean the BBQ. The area should provide sufficient access to reasonably clean the appliance.

A5. Water & Electrical Requirements

Standard BBQ cleaning generally requires: a functioning outdoor water tap suitable for hose connection; and an electrical outlet where required. If these are unavailable, Synsix may perform Dry Cleaning or reschedule.

A6. Dry Cleaning

Dry Cleaning may be required for: built-in BBQs; condominium BBQs; apartment BBQs; balconies; terraces; rooftops; high decks; locations without water access; locations where water use is prohibited; locations where drainage is unsuitable; or other locations where standard wet cleaning is impractical. Dry Cleaning does not produce the same results as standard water-assisted cleaning. Synsix does not guarantee the same cosmetic or cleaning result from Dry Cleaning. due to additional time and materials needed to perform this type of service, dry cleaning has an additional cost.

A7. Built-In BBQs

Built-in BBQs may restrict access to: fireboxes; burners; manifolds; valves; ignition systems; rear panels; side panels; cabinet interiors; ventilation areas ;and concealed components. Synsix will clean reasonably accessible areas. Inaccessible areas cannot be guaranteed to receive the same level of cleaning.

A8. Condominiums, Apartments & Restricted Locations

Customers are responsible for confirming that BBQ cleaning is permitted by the: landlord; condominium corporation; property manager; building; municipality; or other applicable authority. Building restrictions may require Dry Cleaning, modified Service, additional requirements or refusal of Service.

A9. Cleaning Results

BBQ cleaning does not restore an appliance to factory-new condition. Synsix does not guarantee complete removal of: rust; corrosion; oxidation; carbon; permanent grease staining; heat discoloration; burn marks; pitting; scratches; faded finishes; paint failure; warped or bubbling metal; or other age-related deterioration. Results depend upon the appliance's age, material, condition, prior maintenance, use and environmental exposure.

A10. Existing Rust & Corrosion

BBQs naturally experience deterioration due to: heat; moisture; rain; snow; UV exposure; grease; salt; chemicals; age; and normal use. Cleaning may reveal previously concealed corrosion or deterioration. The discovery of such conditions does not establish that Synsix caused them.

A11. Worn Components

Cleaning may reveal components requiring replacement, including: burners; heat shields; flavour bars; cooking grates; ignitors; ignition modules; regulators; valves; hoses; thermometers; grease trays; wheels; casters; warming racks; and other components. Replacement parts and repair labour are additional unless expressly included.

A12. Seized Components

Synsix may decline to remove a seized component where removal presents a significant risk of: breaking hardware; damaging the appliance; creating an unsafe condition; or preventing safe reassembly.

A13. Rodents, Insects & Biohazards

Synsix routinely services BBQs affected by rodent activity, insects, nesting materials, droppings, grease buildup, food debris, and other contamination as part of our applicable BBQ cleaning services. Where reasonably possible, technicians will remove visible contamination, nesting materials, droppings, debris, and other removable biological material encountered within the scope of the Service.

The Customer acknowledges that BBQ cleaning is not pest control, extermination, wildlife removal, or an infestation-prevention service. Synsix does not provide pest-control services and does not guarantee the elimination, prevention, or permanent removal of rodents, insects, birds, wasps, bees, hornets, or other pests from the BBQ, Property, or surrounding area.

Because BBQs are typically located outdoors and may be exposed to weather, food, grease, vegetation, animals, insects, neighbouring properties, environmental conditions, and other factors outside Synsix's control, pests may return immediately or shortly after the BBQ has been cleaned. A subsequent infestation, nesting, droppings, or contamination does not, by itself, indicate that the BBQ was not properly cleaned or that Synsix's Service was defective.

Synsix cannot control or guarantee the condition of the BBQ after the Service has been completed. The Customer is responsible for addressing external factors that may contribute to recurring pest activity, including, where appropriate, food sources, garbage, standing water, surrounding vegetation, openings or access points, improper storage, and other conditions around the Property. Where an ongoing infestation is suspected, the Customer should arrange for an appropriately qualified pest-control or wildlife professional.

Customers should inform Synsix before the appointment if they are aware of significant rodent, insect, wasp, bee, hornet, bird, or other pest activity. Technicians may take reasonable precautions when encountering active pests or biological contamination.

Where technicians encounter an active or unusually hazardous condition that presents a reasonable risk to health or safety, Synsix may pause the affected portion of the Service, take reasonable safety precautions, and determine whether the Service can safely continue. This may include situations involving aggressive or actively swarming insects, large active nests, extensive biological contamination, animal remains, hazardous substances, or conditions beyond the reasonable scope of ordinary BBQ cleaning.

Where the Service can safely proceed, Synsix may clean and remediate the affected area as part of the applicable Service. Additional labour, specialized cleaning, disposal, protective equipment, or other costs may apply where the extent of contamination is materially greater than reasonably contemplated by the original booking or quotation. Any additional charge will be communicated to the Customer where reasonably practicable before the additional work is performed.

Synsix does not guarantee that all stains, odours, discoloration, biological residue, corrosion, nesting damage, or other physical evidence associated with pest activity can be completely removed. Some contamination may have caused permanent staining, corrosion, deterioration, or damage to components or surfaces before Synsix's arrival.

The Customer acknowledges that pest activity may also cause or contribute to damage to wiring, insulation, igniters, burners, hoses, electrical components, controls, grease-management systems, and other BBQ components. Synsix may identify such conditions during cleaning and may recommend replacement or repair where appropriate. Any replacement parts, repairs, or additional services are subject to additional charges unless expressly included in the original Service.

Where pest activity has contaminated or damaged a component to the point that cleaning alone cannot reasonably restore it, Synsix may recommend replacement rather than continued use. Synsix does not guarantee the functionality, safety, or serviceability of components that are damaged, deteriorated, contaminated, or defective before the Service.

The Customer is responsible for notifying Synsix of any known hazards, aggressive animals, active nests, or other conditions that could reasonably affect the safety of the technicians. Synsix may refuse to handle or directly disturb an active nest or aggressive pest where doing so would create an unreasonable safety risk.

Most importantly, completion of a BBQ cleaning does not constitute a certification that the BBQ is pest-free, contamination-free, or protected against future infestation. The Service addresses conditions present and reasonably accessible at the time of service; it does not control future environmental or pest activity.

A14. BBQ Maintenance Customer Responsibility

Customers are responsible for ongoing: cleaning; maintenance; grease-tray management; inspection; safe operation; and replacement of worn components. A cleaning service does not eliminate the possibility of future grease buildup, flare-ups or fires.

SCHEDULE B — BBQ REPAIRS & DIAGNOSTICS

B1. Diagnostic Services

A diagnostic Service is intended to identify reasonably observable or testable causes of a reported issue. A diagnostic does not guarantee that every defect will be identified or that the appliance can be repaired. A diagnostic fee covers inspection and testing only unless otherwise stated. Parts, repairs, additional labour and return visits are at an additional cost.

B2. Repair Estimates

Repair estimates are based on available information. Pricing may change if disassembly reveals: hidden corrosion; damaged components; seized hardware; electrical damage; gas deficiencies; structural deterioration; or other conditions not reasonably visible before disassembly. Additional repairs will not be performed without Customer authorization where required, except where immediate action is necessary for safety or compliance with law.

B3. Parts Availability

Synsix does not guarantee that parts remain available for every appliance. Manufacturers may discontinue components or experience supply delays.

B4. Customer-Supplied Parts

Synsix does not guarantee Customer-supplied parts for: compatibility; quality; manufacturer defects; completeness; or suitability. Labour performed using Customer-supplied components is limited to workmanship. Additional visits caused by incorrect or defective Customer-supplied parts may be chargeable.

B5. Gas Testing After BBQ Repairs

Where gas service is required for the requested Service, the Customer is responsible for ensuring that a safe, accessible, and operational gas supply is available at the time of the appointment. This includes ensuring that the applicable gas shut-off valve, appliance connection, meter, regulator, or other required gas supply components are reasonably accessible to the technician.

Where gas work, diagnosis, repair, installation, commissioning, or testing is included in the Service, gas must be available and accessible when required in order for Synsix to properly perform and verify the work. Synsix cannot complete certain repairs, diagnostics, commissioning, functionality testing, or leak testing where the gas supply has been shut off, disconnected, inaccessible, unavailable, or otherwise unable to supply gas to the appliance or equipment.

Where reasonably applicable, the Customer may be required to provide access to the gas meter, shut-off valve, appliance connection, or other components necessary for the technician to safely perform and verify the Service.

Where gas is available, Synsix may perform reasonable operational, functionality, and/or leak testing of the components and connections directly serviced, installed, repaired, or modified by Synsix. Testing may include confirming that the serviced connection is functioning as intended at the time of the Service and checking for leaks using appropriate testing methods.

Testing of a serviced component does not constitute an inspection, certification, warranty, or guarantee of the entire gas system, appliance, property, or installation, unless a separate service specifically providing such inspection, certification, or assessment has been expressly quoted and accepted.

Synsix is not responsible for conditions that prevent testing or verification where those conditions are outside Synsix's control, including but not limited to:

  • No gas supply;

  • Gas supply being shut off;

  • Inaccessible gas meters, shut-off valves, or connections;

  • Disconnected or improperly connected gas lines;

  • Utility or supplier interruptions;

  • Insufficient gas supply or pressure;

  • Existing defects or deficiencies in the gas system;

  • Appliance or equipment failures unrelated to Synsix's work; or

  • Conditions that make testing unsafe or otherwise unreasonable.

If the technician attends the Property and is unable to perform, complete, diagnose, repair, commission, or properly test the requested Service because gas access or gas supply is unavailable, Synsix may be unable to complete the Service during that appointment. In such circumstances, the applicable $50 call-out fee will apply where the inability to perform the Service is caused by conditions within the Customer's responsibility or control, including failure to provide required gas access or a usable gas supply.

If a return visit is required after the Customer provides the necessary gas supply or access, the return visit may be subject to additional service or labour charges unless otherwise agreed in writing.

The Customer should not turn gas valves on or off, reconnect gas appliances, modify gas piping, or otherwise alter the gas system for the purpose of preparing for the appointment unless permitted to do so under applicable law. Where required, Synsix will determine the appropriate procedure for safely accessing, restoring, testing, or commissioning the gas service.

Synsix will not knowingly proceed with gas work where the technician determines that the available conditions create an unsafe situation or where the required gas supply cannot be safely established. Any required remediation, additional work, parts, or return visit may be subject to additional charges.

Nothing in this Section limits any statutory right, safety requirement, TSSA requirement, or other legal protection that cannot lawfully be excluded or restricted.

B6. Future Appliance Operation

Repairing one component does not guarantee that other components will not fail. Future failures may result from: age; corrosion; heat cycling; weather; manufacturer defects; normal wear; lack of maintenance; or unrelated conditions.

B7. Grease Fires & Flare-Ups

Cleaning or repairing a BBQ does not eliminate the possibility of future grease fires or flare-ups. Future grease fires may result from: subsequent grease accumulation; cooking practices; high-fat foods; overflowing grease trays; oil spills; leaving the appliance unattended; improper operation; manufacturer defects; or other circumstances outside Synsix's control. Synsix does not guarantee that a BBQ will never experience a future grease fire or flare-up.

B8. Commercial BBQs

Commercial, institutional, hospitality and high-volume BBQs experience greater wear than residential appliances. Synsix may recommend replacement instead of repair where repair is no longer practical, economical or reasonably safe.

SCHEDULE C — WHITE GLOVE BBQ SERVICE

C1. Scope

White Glove Service may include, where specifically included in the quotation: delivery of the BBQ; professional assembly; placement; connection to an existing compatible gas supply; gas leak testing of connections made or disturbed by Synsix; functional testing; ignition testing; burner flame inspection; packaging removal; recycling of packaging; removal/recycling of one existing BBQ where included; exterior polishing; ceramic coating where included; complimentary Synsix cleaning products where included; basic operating overview; and maintenance recommendations. Only items expressly included in the quotation are included.

C2. Delivery

Customers must provide: safe delivery access; clear walkways; adequate clearance; elevator access where required; building approvals; parking; and any other required access arrangements. Undisclosed access restrictions may result in additional charges or rescheduling.

C3. Assembly

Synsix will assemble the BBQ according to manufacturer instructions where available. Synsix does not intentionally modify the manufacturer's design.

C4. Manufacturer Defects

Synsix is not the manufacturer of the BBQ. Manufacturer defects should generally be addressed through the manufacturer or supplier warranty process. Where a BBQ arrives damaged, defective or incomplete, Synsix may recommend that the product be exchanged or that replacement components be obtained before assembly continues.

C5. Placement

Final placement is subject to: manufacturer clearances; building requirements; combustible-material clearances; ventilation; accessibility; gas connection requirements; and technician safety. Synsix may refuse placement in an unsafe or non-compliant location.

C6. Gas Connection

Where included, gas connections will be performed by appropriately qualified personnel as required by Ontario law. Only the gas work expressly included in the quotation is included. Additional gas work may require a separate quotation.

C7. Leak Testing

Synsix will perform reasonable leak testing of gas connections installed or disturbed by Synsix. This does not constitute certification of: the entire gas system; concealed piping; inaccessible fittings; unrelated appliances; or Customer-installed gas components.

C8. Functional Testing

Testing may include: ignition; burners; flame pattern; thermometer; side burner; rotisserie burner; control knobs; and other applicable functions. Testing confirms only that the appliance appeared to function reasonably at the time of completion.

C9. Old BBQ Removal

Where included, Synsix may remove one existing BBQ. The BBQ must be: reasonably accessible; and free of personal belongings. Additional or hazardous appliances may require additional charges or may be refused.

C10. Packaging Removal

Where included, Synsix will remove standard packaging generated from the installation. Hazardous, contaminated or pest-infested packaging may be excluded.

C11. Ceramic Coating

Ceramic coating is intended to assist with surface protection and routine maintenance. It does not: prevent rust; eliminate corrosion; prevent scratches; eliminate heat discoloration; permanently protect finishes; or eliminate future cleaning.

SCHEDULE D — GAS SERVICES

D1. Regulatory Compliance

Gas Services will be performed in accordance with applicable Ontario legislation, regulations, codes, manufacturer requirements and regulatory requirements. Where regulated gas work is required, it will be performed by tssa certified gas technicians.

D2. Gas Services

Gas Services may include: gas diagnostics; leak testing; gas line installation; gas line modifications; gas line extensions; gas line capping or uncapping; appliance connections; valve installation; quick-connect installation; regulator replacement; hose replacement; commissioning; pressure testing where applicable; appliance disconnection; approved BBQ conversions; and other permitted gas work.

D3. Gas Diagnostics

Gas diagnostics may address: ignition failure; weak flames; yellow flames; uneven burner operation; suspected leaks; low gas pressure; regulator issues; intermittent operation; or other gas-related concerns. A diagnostic does not guarantee discovery of concealed, intermittent or future defects.

D4. Gas Leak Testing

Where gas connections are installed, altered or disturbed by Synsix, appropriate leak testing will be performed on the applicable serviced connections. Leak testing does not certify the entire gas installation.

D5. Existing Gas Systems

Existing gas systems may contain: improper prior installations; existing leaks; corrosion; defective regulators; defective valves; improper venting; concealed defects; code deficiencies; or manufacturer defects. Repairing one component does not constitute inspection or certification of the entire gas system.

D6. Unsafe Gas Conditions

If a Synsix gas technician identifies an unacceptable gas condition or immediate hazard, Synsix will take the action required by applicable law and regulatory requirements. This may include: stopping work; shutting off gas; disconnecting an appliance; issuing required written notice or documentation; affixing a required notice or tag; notifying the gas distributor; refusing to restore service; or requiring corrective work before the appliance can safely return to service. These actions are safety and regulatory obligations and are not subject to Customer approval where the law requires Synsix to act.

D7. Immediate Gas Safety Hazards, Unacceptable Conditions & Regulatory Notices

All gas-related services performed by Synsix will be carried out by appropriately qualified personnel and in accordance with applicable Ontario legislation, regulations, codes, standards, manufacturer requirements, and TSSA requirements applicable to the work.

Gas work may be subject to the Technical Standards and Safety Act, 2000, Ontario Regulation 212/01 – Gaseous Fuels, the applicable TSSA Gaseous Fuels Code Adoption Document, and the applicable edition and Ontario amendments of CSA B149.1 – Natural Gas and Propane Installation Code, as adopted in Ontario. As of June 1, 2026, TSSA's Gaseous Fuels Code Adoption Document adopts CSA B149.1 (2025), with Ontario amendments.

If a Synsix gas technician identifies an unacceptable condition that constitutes an immediate hazard, Synsix will take the actions required by applicable law and TSSA requirements.

An immediate hazard may include, depending on the circumstances, conditions involving an unsafe gas leak, unsafe combustion, dangerous venting, improper installation, damaged gas components, unsafe appliance operation, or another condition that presents an immediate risk to persons or property.

Where required by applicable law, the technician may:

  • Immediately shut off the gas supply to the affected appliance or work;

  • Prevent the affected appliance from being operated;

  • Affix the required regulatory notice/tag to the appliance or work;

  • Provide the required notice to the Customer/user;

  • Notify the applicable gas distributor and/or TSSA where required;

  • Document the condition through photographs, technician notes, testing results, and other service records; and

  • Take any other action required by applicable legislation, regulation, code, or TSSA requirements.

Under O. Reg. 212/01, where an unacceptable condition constitutes an immediate hazard, the owner or user must not use, or permit the use of, the affected appliance or work until the condition has been corrected.

The Customer must comply with any direction issued by the technician relating to an immediate gas hazard and must not operate, use, reconnect, restore gas to, or permit the use of the affected appliance or gas work until the condition has been properly corrected and the applicable regulatory requirements have been satisfied.

Where applicable, Synsix may issue or affix the appropriate regulatory notice commonly referred to as an “A Tag” or immediate-hazard tag, in accordance with the applicable regulatory requirements.

An A Tag or other regulatory notice is not a discretionary service recommendation. Where the applicable legislation requires a notice to be issued or affixed because an immediate hazard has been identified, Synsix will comply with those requirements.

Customers must not remove, alter, conceal, damage, deface, bypass, or otherwise interfere with an A Tag, red tag, regulatory notice, or other safety notice affixed to an appliance or gas work.

Under O. Reg. 212/01, a notice affixed in these circumstances may only be removed by a person holding the appropriate certificate and following the prescribed regulatory process.

Attempting to remove a tag, restore gas service, operate the appliance, or have another person bypass the identified condition does not constitute a lawful correction of the hazard and may create additional safety and regulatory concerns.

Not every code or compliance deficiency constitutes an immediate hazard. Where a qualified technician identifies an unacceptable condition that does not constitute an immediate hazard, Synsix will follow the applicable requirements under O. Reg. 212/01 and applicable TSSA procedures.

Depending on the condition and applicable requirements, this may include providing written notice to the Customer/user, notifying the gas distributor, affixing the appropriate notice to the appliance or work, documenting the deficiency, and providing information regarding the required corrective action.

A condition that does not constitute an immediate hazard may be subject to a prescribed period for correction. The Customer is responsible for ensuring that identified deficiencies are corrected within the applicable timeframe and in accordance with applicable law.

A non-immediate-hazard notice is sometimes commonly referred to as a “B Tag.” The Customer must not assume that a B Tag means that the equipment is fully compliant or that no action is required.

Where a regulatory notice is affixed, the Customer must not remove, alter, conceal, or interfere with the notice except as permitted by applicable law. TSSA materials state that removal of applicable notices requires the appropriate certified person and prescribed process.

Once Synsix has identified and communicated an unsafe or unacceptable gas condition, the Customer is responsible for:

  • Following the technician's safety instructions;

  • Not using the affected appliance where use is prohibited;

  • Not attempting to repair or modify the gas system themselves;

  • Not hiring an unqualified or uncertified person to bypass or correct the condition;

  • Providing reasonable access for required corrective work;

  • Completing required repairs or remediation within the applicable timeframe;

  • Ensuring that any subsequent gas work is performed by an appropriately qualified and authorized person; and

  • Complying with any requirements imposed by TSSA, the gas distributor, applicable legislation, regulation, or code.

TSSA states that gas appliance work in Ontario must be performed by TSSA-registered contractors and appropriately certified fuel technicians.

Correction of the underlying condition does not automatically authorize the Customer to remove a regulatory tag or notice.

Where a tag or notice has been issued, the applicable regulatory process must be followed before the equipment is returned to service. Where required, the correction must be completed and verified by an appropriately qualified certificate holder, and the applicable notice must be cleared in accordance with the requirements of O. Reg. 212/01 and TSSA procedures.

Synsix will not remove, clear, or certify a regulatory notice unless authorized and qualified to do so and unless the applicable requirements have been satisfied.

If Synsix identifies an immediate gas hazard and the Customer refuses or declines to authorize corrective work, Synsix will not be required to continue work that would place the technician, Customer, occupants, or property at unreasonable risk.

Where required by law, Synsix may shut off the gas supply, affix the applicable regulatory notice, notify the gas distributor and/or TSSA, and take any other action required by law.

A Customer's refusal to authorize recommended corrective work does not permit Synsix to knowingly leave an immediate hazard in operation where applicable law requires the appliance or gas work to be shut down or otherwise dealt with.

Synsix may document the Customer's refusal, including through photographs, written notes, invoices, service reports, or other records.

Gas systems, appliances, piping, venting, regulators, valves, connectors, controls, burners, and related components may contain pre-existing conditions that are not apparent until an inspection, diagnosis, cleaning, repair, or other service is performed.

The discovery of a gas safety deficiency during Synsix's Service does not necessarily mean that Synsix caused the condition.

Synsix is not responsible for pre-existing code deficiencies, improper installations, deterioration, corrosion, damage, unauthorized modifications, defective components, or other conditions that existed before Synsix's involvement, subject always to applicable statutory rights and legal requirements.

Where Synsix identifies a condition outside the originally requested scope of work, the Customer may be provided with a recommendation or quotation for corrective work. Synsix is not obligated to perform additional work without appropriate authorization, except where an action is required by applicable law or necessary to address an immediate safety condition.

Unless expressly included in the quoted Service, a diagnosis, repair, installation, leak test, or other gas service performed by Synsix does not constitute a complete inspection or certification of the entire property, gas piping system, appliance, venting system, electrical system, or all related components.

Testing performed by Synsix is generally limited to the components, connections, appliance, or gas work within the scope of the Service.

The Customer acknowledges that correcting one identified gas issue does not necessarily establish that the entire gas system or appliance is free from other defects or code deficiencies.

Synsix's priority is the safe operation of gas-fired equipment and protection of people and property. Where there is a conflict between the Customer's requested work and an applicable safety requirement, regulation, code, manufacturer requirement, or TSSA requirement, Synsix will prioritize compliance with the applicable safety requirement.

Synsix may refuse to perform, stop, or limit gas work where the technician reasonably determines that the requested work cannot be safely or lawfully completed.

Nothing in this Section authorizes Synsix or a Customer to disregard any requirement imposed by TSSA, the Technical Standards and Safety Act, O. Reg. 212/01, the applicable TSSA Code Adoption Document, CSA B149.1, manufacturer instructions, or any other applicable law or safety standard.

D8. Customer Refusal of Corrective Work, Safety Notices & Regulatory Compliance

A Customer may decline recommended repairs, replacement parts, remediation, or other corrective work where permitted by applicable law. However, a Customer's refusal does not require or permit Synsix, its technicians, or representatives to perform, continue, reconnect, activate, or restore gas service where doing so would violate applicable legislation, regulations, codes, TSSA requirements, manufacturer requirements, or other applicable safety requirements.

Where a Synsix technician identifies an unacceptable condition affecting an appliance, gas installation, gas piping, equipment, or other gas work, the technician will determine the appropriate course of action based on the nature and severity of the condition and the requirements applicable at the time.

Where an unacceptable condition constitutes an immediate hazard, Synsix will take the actions required by applicable law and TSSA requirements. This may include, where required:

  • Immediately shutting off the gas supply to the affected appliance or gas work;

  • Instructing the Customer that the affected appliance or gas work must not be used until the condition has been corrected;

  • Providing the required oral and written notice to the Customer/user;

  • Providing the required notice to the applicable gas distributor;

  • Affixing the applicable regulatory notice or tag to the affected appliance or gas work;

  • Documenting the hazardous condition through photographs, testing results, technician notes, and service records; and

  • Taking any other action required by applicable legislation, regulation, code, or TSSA requirements.

Ontario Regulation 212/01 requires a certificate holder who identifies an unacceptable condition constituting an immediate hazard to immediately shut off the gas supply, provide the required notices, notify the distributor within the prescribed timeframe, and affix the required notice. The owner or user must not use or permit use of the affected appliance or work until the condition is corrected.

An immediate-hazard notice is commonly referred to as an “A Tag.” Where the applicable regulatory requirements require an A Tag or equivalent notice, Synsix may issue and affix the required notice in accordance with those requirements.

The Customer must not remove, alter, conceal, damage, deface, bypass, or otherwise interfere with an A Tag or other regulatory safety notice. Ontario Regulation 212/01 restricts removal of such notices to persons holding the appropriate certificate and following the prescribed process.

Non-Immediate Unacceptable Conditions

Where Synsix identifies an unacceptable condition that does not constitute an immediate hazard, Synsix will follow the applicable regulatory requirements.

Depending on the circumstances, this may include notifying the Customer/user and the applicable gas distributor, documenting the condition, and affixing the appropriate regulatory notice.

Such a condition is commonly referred to as a “B Tag” condition, although the applicable regulatory requirements and notice process will govern regardless of terminology.

A B Tag or other non-immediate-hazard notice does not mean that the condition may be ignored. Where applicable law establishes a correction period, the Customer is responsible for ensuring that the condition is corrected within the required timeframe. Under O. Reg. 212/01, an owner or user may not continue using or permit use of the affected appliance or work after the applicable correction period expires until the condition has been corrected.

If a Customer refuses recommended corrective work, Synsix will document the refusal where reasonably appropriate.

A Customer's refusal to authorize repairs does not create an obligation for Synsix to leave an unsafe appliance operating or to restore a gas supply that has been shut off due to a safety or regulatory concern.

Where legally required, Synsix may:

  1. Shut off the gas supply to the affected appliance or gas work;

  2. Affix the applicable regulatory notice or tag;

  3. Notify the Customer/user of the condition and required restrictions on use;

  4. Notify the applicable gas distributor and/or TSSA;

  5. Provide any required written documentation;

  6. Decline to perform additional work until the unsafe or unacceptable condition has been appropriately addressed; and

  7. Take any other action required by applicable law or regulation.

Synsix will not knowingly reconnect, activate, restore, or permit the use of gas equipment where doing so would create an immediate safety hazard or violate applicable law.

Where applicable legislation requires a qualified technician to shut off gas, issue a notice, notify a distributor, or otherwise take action in response to an identified hazard, the Customer's refusal, disagreement, or failure to authorize the action does not prevent Synsix from taking the action required by law.

The Customer acknowledges that Synsix's obligation to comply with applicable gas-safety legislation takes precedence over a Customer's request to continue operating affected equipment.

A Customer must not remove or arrange for the removal of a regulatory tag or notice merely because the Customer disagrees with the finding or wishes to resume using the appliance.

Where a regulatory notice has been affixed, the applicable regulatory process must be followed before the equipment is returned to service. Where required, the underlying condition must be corrected and the notice must be removed or cleared by a person legally authorized to do so.

Synsix will not remove or clear a regulatory notice unless the technician is legally authorized to do so and the applicable requirements for removal have been satisfied.

Once Synsix has identified an unsafe or unacceptable condition, the Customer is responsible for complying with all applicable restrictions and ensuring that required corrective work is completed.

The Customer must not:

  • Reconnect an appliance that Synsix has disconnected for safety reasons;

  • Turn a gas valve back on after Synsix has shut it off due to an identified hazard;

  • Bypass a safety device or regulatory notice;

  • Remove or interfere with a regulatory tag;

  • Operate an appliance contrary to written safety instructions;

  • Permit another person to operate equipment that is prohibited from use; or

  • Hire an unqualified person to circumvent or bypass a gas safety restriction.

Ontario's regulation places a duty on owners/users to maintain gas appliances and work in safe operating condition.

Where a Customer refuses corrective work and a subsequent visit is required after the Customer later authorizes the necessary repairs, the subsequent visit, labour, parts, testing, documentation, travel, and other applicable services will be charged separately unless otherwise agreed in writing.

Synsix is not responsible for delays, loss of use, additional service costs, appointment availability, or other consequences resulting from a Customer's decision to decline or delay required corrective work, to the extent permitted by applicable law.

Nothing in this Section limits or excludes any statutory right, consumer protection, safety requirement, warranty, remedy, or other legal protection that cannot lawfully be excluded or restricted.

D9. Gas Appliance Performance

Gas appliance performance depends on factors including: gas supply; propane supply; regulator condition; appliance condition; burners; orifice sizing; weather; manufacturer design; and other factors. Synsix does not guarantee future appliance performance outside the scope of the work performed.

D10. Gas Customer Responsibilities

After gas work, the Customer must: operate appliances according to manufacturer instructions; maintain appliances; keep combustion-air openings unobstructed; monitor for abnormal operation; avoid unauthorized modifications; and immediately stop using an appliance suspected of leaking gas.

SCHEDULE E — PRODUCT SALES

E1. Product Selection

Synsix sells and recommends products based on: quality; reliability; manufacturer reputation; parts availability; serviceability; professional experience; intended use; cooking requirements; fuel type; space; and Customer needs. Synsix only offers products it believes it can reasonably recommend and stand behind. A recommendation is based on information supplied by the Customer. The Customer remains responsible for confirming that the Product meets their personal preferences and requirements.

E2. Product Availability

Products are subject to manufacturer and supplier availability. Manufacturers may: discontinue products; change specifications; change colours; substitute components; alter packaging; change pricing; or experience delays. If a purchased Product becomes unavailable, Synsix may offer a comparable replacement, refund or other mutually agreed solution, subject to applicable law.

E3. Product Pricing

Prices are generally quoted in Canadian dollars. Applicable taxes are additional unless otherwise stated. Delivery, installation, assembly, parking, permits and additional labour are not included unless expressly stated.

E4. Special Orders

Special Orders may require payment or a deposit before the order is submitted to the supplier. Cancellation and refund rights remain subject to applicable law and the applicable sales agreement.

E5. Returns & Exchanges

Returns and exchanges are subject to: applicable law; manufacturer policies; supplier policies; and Synsix's written return policy. Nothing in this Section removes a statutory consumer right.

E6. Product Warranty

Manufacturer warranties remain subject to manufacturer terms. Synsix's workmanship warranty applies only to labour directly performed by Synsix where a workmanship warranty is provided.

SCHEDULE F — YARD MAINTENANCE

F1. Scope

Yard Services may include: lawn mowing; edging; spring clean-ups; fall clean-ups; leaf removal; garden-bed maintenance; hedge trimming; shrub pruning; small tree pruning from ground level; weed removal; mulch installation; soil installation; planting; yard clean-ups; and other services expressly included. Unless stated otherwise, Synsix does not provide the following services including but not limited to: tree removal; stump grinding; excavation; grading; irrigation installation; arborist services; pesticide application; or work requiring specialized licensing.

F2. Photographs

Customers are encouraged to provide photographs of: front yard; backyard; side yards; gardens; hedges; trees; problem areas; and hazards. Estimates may change where actual site conditions materially differ.

F3. Work Area

Customers must remove or secure: toys; hoses; ornaments; furniture; sports equipment; electrical cords; decorations; and other items that may interfere with work.

F4. Hidden Systems

Customers must identify privately installed or concealed systems including: irrigation; sprinkler lines ;invisible fencing; landscape lighting; underground wiring; drainage; water lines; gas lines; and other concealed systems. Synsix is not responsible for damage to concealed systems that were not reasonably visible or disclosed, except to the extent required by law.

F5. Trees & Shrubs

Synsix's standard pruning and trimming is performed from ground level. Unless specifically agreed otherwise, Synsix does not perform: climbing; ladder work; elevated pruning; tree removal; hazardous-tree removal; or arborist services. Future growth, flowering, plant health and appearance cannot be guaranteed.

F6. Mulch, Soil & Materials

Materials such as: mulch; soil; compost; stone; gravel; plants; and seed are an additional cost unless included in the quotation. Natural materials may vary in: colour; texture; moisture; particle size; and appearance.

F7. Weed Removal

Manual weed removal reduces visible weeds at the time of service. It does not guarantee permanent weed elimination. Future growth depends on environmental and maintenance conditions. Herbicide or pesticide application is not provided by synsix.

F8. Yard Waste

Unless otherwise agreed, standard yard maintenance does not include off-site waste removal. Yard debris may be: collected; bagged; and placed in an agreed location for municipal collection. Off-site disposal is an additional service and at an additonal cost.

F9. Dog Waste

Customers must ensure work areas are free of dog waste before the appointment. Where dog waste is present, Synsix may: suspend work; reschedule; refuse service; or charge an additional fee where removal is agreed. Dog-waste removal is not included in standard yard maintenance.

F10. Seasonal Conditions

Synsix cannot guarantee permanent lawn or landscape appearance. Grass, plants and gardens are affected by: weather; drought; watering restrictions; pests; wildlife; soil conditions; disease; seasonal growth; sunlight; and other environmental factors.

SCHEDULE G — JUNK REMOVAL

G1. Scope

Junk Removal may include: household junk; furniture; BBQs; appliances; non-hazardous renovation debris; garage clean-outs; basement clean-outs; shed clean-outs; estate clean-outs; storage clean-outs; office clean-outs; and other non-hazardous materials. Unless expressly agreed, Synsix does not provide: asbestos removal; hazardous-waste removal; biohazard cleanup; mold remediation; or environmental remediation.

G2. Photographs

Customers should provide photographs or videos accurately showing: quantity; size; weight; accessibility; stairs; elevators; parking; location; and any hazards. Quotes may change where actual conditions materially differ.

G3. Customer Ownership

The Customer represents that they own or have authority to dispose of all property designated for removal. The Customer is responsible for ensuring that valuable or wanted property is removed before the Service begins.

G4. Abandoned Property

Once an item has been removed from the Property, it may be: disposed of; recycled; donated; salvaged; transferred; or otherwise handled by Synsix or a disposal facility. Removed items may not be recoverable.

G5. Prohibited Materials

Synsix may refuse materials that are hazardous, illegal, regulated, contaminated or unsafe. Examples include: asbestos; hazardous chemicals; solvents; fuels; ammunition; firearms; explosives; biomedical waste; sharps; human or animal waste; radioactive materials; controlled substances; toxic substances; and other prohibited materials.

G6. Heavy & Specialty Items

Specialty items may require additional labour or equipment, including: hot tubs; pianos; large commercial equipment; concrete; soil; pool tables; heavy machinery; safes; and other unusually heavy items. Synsix may decline removal where appropriate equipment is unavailable.

G7. Disposal Charges

Unless expressly included, disposal costs are additional, including: dump fees; landfill fees; transfer-station fees; recycling fees; environmental fees; bin rentals; and other disposal charges.

G8. Access

Customers must disclose: stairs; narrow hallways; tight doorways; low ceilings; elevators; long carrying distances; gated access; construction areas; and parking limitations. Additional labour or rescheduling may apply where conditions differ from those disclosed.

SCHEDULE H — ASSEMBLY SERVICES

H1. Assembly Instructions

Customers must provide the manufacturer’s assembly instructions/manual for the product prior to the scheduled assembly service. Our technicians require the correct manufacturer instructions to ensure the product is assembled safely and according to the manufacturer’s specifications.

If the required assembly instructions are not available at the time of service, Synsix may be unable to complete the assembly. If our team arrives onsite and is unable to perform the service due to missing or unavailable manufacturer instructions, the applicable service/call-out fee will still apply.

Customers are responsible for ensuring that the correct assembly instructions are available and accessible prior to our team’s arrival.

H2. Product Condition

Synsix does not manufacture Customer-supplied Products. If an item is: damaged; defective; incomplete; unsafe; or missing required components, Synsix may recommend that the Customer obtain a replacement before assembly. If our team arrives onsite and is unable to perform the service the applicable service/call-out fee will still apply.

H3. Large Projects

Large assemblies may require several hours or multiple days. Examples include: sheds; gazebos; playsets; large outdoor structures; and complex assemblies. Completion times are estimates.

H4. Excluded Assemblies

Synsix may decline assemblies requiring: specialized engineering; structural certification; specialized licensing; unsafe ladder work; specialized lifting equipment; pool installation; or work outside Synsix's normal service scope.

H5. Disassembly

Synsix may disassemble an item previously assembled by Synsix where required for reassembly. Items being demolished or disposed of may be disassembled regardless of who originally assembled them, where the Service is agreed.

H6. Packaging

Unless otherwise stated in writing, Synsix does not provide off-site disposal of assembly packaging. Disposal services are at an extra cost. Packaging may be broken down and placed in a Customer-designated location.

H7. Outdoor Assembly

Outdoor assemblies may be postponed due to: rain; snow; freezing temperatures; high winds; lightning; excessive heat; or other unsafe conditions.

SCHEDULE I — PAYMENT & SCHEDULING SUMMARY

For convenience, the following standard operational fees may apply where applicable:

Call-Out Fee $50 + applicable tax

Reserved Time Fee $40 + applicable tax

Weekend Reservation Fee $50 + applicable tax

Rush Service$50–$500 + applicable tax

All fees are subject to availability, the applicable quotation or booking confirmation, the circumstances of the Service, and applicable law. Synsix may provide a specific quotation where the circumstances of the Service require pricing different from the standard amounts above.

SCHEDULE J — STANDARD BBQ ARRIVAL & SERVICE NOTICE

J1. Photographs

For BBQ Services, Customers are encouraged to provide clear photographs of the BBQ, surrounding area, access points and any reported issue before the scheduled Appointment whenever possible.Photographs may be sent by text message to 647-861-3888.Providing photographs may assist Synsix in determining the appropriate Service, required equipment, estimated pricing and any potential access or service limitations.

J2. Standard BBQ Arrival Windows

Arrival Windows are estimates and are not guaranteed exact arrival times unless the Customer has purchased and Synsix has expressly confirmed a Reserved Time Appointment.

J3. Expected Service Duration

Customers should generally expect BBQ Services to take approximately 45 minutes to 4 hours, depending on the BBQ, Service purchased, condition of the equipment, access, required work and conditions encountered onsite. A typical BBQ cleaning generally takes approximately 1.5 hours; however, actual Service duration may vary.

J4. Customer Requirements

Customers are responsible for ensuring, where applicable: reasonable access to the BBQ; access to a functioning outdoor water source; access to a functioning electrical outlet where required; a safe and reasonably accessible Work Area; clear access to the BBQ and surrounding Work Area; pets are secured and do not interfere with the Service; building, condominium, property management or other required approvals have been obtained; and any other requirements communicated by Synsix before the Appointment are satisfied. Failure to meet applicable requirements may prevent or delay the Service and may result in applicable fees.

SCHEDULE K — SERVICE COMPLETION & CUSTOMER REVIEW

K1. Completion of Service

A Service will generally be considered complete when: the agreed scope of work has been performed; applicable Service documentation has been completed; the Customer has been given a reasonable opportunity to identify concerns; or Synsix has documented why any remaining work could not reasonably be completed. Where the Customer is not present, Synsix may document completion through photographs, technician notes, electronic records and other reasonable documentation.

K2. Customer Concerns

Customers should notify Synsix promptly after discovering any concern relating to the Service. Where a Customer alleges a workmanship issue, Synsix should be provided with a reasonable opportunity to inspect the issue and, where appropriate, remedy the alleged workmanship issue before another contractor alters, repairs or replaces Synsix's work. This requirement does not apply where immediate action is reasonably necessary to protect health, safety or property. Nothing in these Terms is intended to eliminate or restrict any statutory right, warranty, remedy or protection that cannot legally be excluded or restricted.

SCHEDULE L — DEFINITIONS

L1. "Appointment"

A scheduled date on which Synsix intends to attend the Property. An Appointment does not guarantee an exact arrival time unless a Reserved Time Appointment has been expressly confirmed by Synsix.

L2. "Arrival Window"

The estimated period during which Synsix expects to arrive at the Property. Arrival Windows are estimates and may be affected by weather, traffic, service duration, access issues, prior appointments, emergencies, unforeseen conditions and other circumstances outside Synsix's reasonable control.

L3. "Reserved Time Appointment"

An Appointment for which Synsix has expressly agreed to reserve a specific time or narrower arrival period.

L4. "Weekend Reservation"

A weekend Appointment specifically approved and reserved by Synsix and subject to any applicable Weekend Reservation Fee.

L5. "Rush Service"

A Service requested on an expedited basis that requires Synsix to prioritize the Appointment ahead of ordinary scheduling availability. Rush Services are subject to availability and applicable Rush Service fees.

L6. "Call-Out Fee"

The applicable fee charged where Synsix attends the Property but cannot reasonably perform the scheduled Service due to circumstances attributable to the Customer or circumstances outside Synsix's reasonable control.

L7. "Dry Cleaning"

A BBQ cleaning method performed without Synsix's standard water-assisted cleaning process by a hose.

L8. "Standard BBQ Cleaning"

The BBQ cleaning Service described in the applicable quotation, booking confirmation or Service description.

L9. "White Glove Service"

The premium BBQ delivery, assembly, placement, gas connection where included, testing, packaging removal, old BBQ removal where included, polishing, ceramic coating where included and Customer orientation services identified in the applicable quotation.

L10. "Gas Service"

Any gas-related Service provided by Synsix, including but not limited to: diagnostics, leak testing, connection, installation, repair, commissioning, valve installation, quick-connect installation and other gas work performed within Synsix's authorized scope.

L11. "Diagnostic"

An inspection or testing Service intended to identify the reasonably observable or testable cause of a reported issue. A Diagnostic does not include repair, replacement, remediation or correction of the identified issue unless expressly included in the applicable quotation.

L12. "Hazardous Condition"

A condition that, in Synsix's reasonable professional judgment or under applicable law or regulatory requirements, creates or may create a risk to people, property, equipment, employees, contractors or the public.

L13. "Property"

The residence, commercial property, condominium, apartment, yard, building, workplace, outdoor area or other location where Synsix is providing or has been requested to provide Products or Services.

L14. "Work Area"

The area reasonably required by Synsix personnel to safely perform the Service.

L15. "Product"

Any BBQ, appliance, accessory, replacement part, gas component, cleaning product, equipment, material or merchandise sold or supplied by Synsix.

L16. "Workmanship"

The quality of labour directly performed by Synsix in completing the specific Service purchased.Workmanship does not include the future condition, deterioration, performance or failure of Customer-owned equipment or third-party Products.

L17. "Business Day"

A day on which Synsix is ordinarily open for business, excluding statutory holidays and scheduled business closures.

FINAL CUSTOMER ACKNOWLEDGEMENT

By booking, purchasing, paying for or authorizing a Synsix Product or Service, the Customer acknowledges that they have had an opportunity to review the applicable Service Agreement & Terms of Service and understand that: different Services have different requirements; standard Arrival Windows are estimates and are not guaranteed exact appointment times; Reserved Time and Weekend Reservation Fees may apply;Rush Service is subject to availability and applicable fees;estimates may change when actual conditions materially differ from the information provided;additional charges may apply for additional work, parts, materials, parking, disposal, access or third-party costs;existing wear, deterioration, damage and hidden conditions may be discovered during Service;certain Services may require access to water, electricity, gas or other utilities;certain Services may require Dry Cleaning or modified procedures;weather and other circumstances may require an Appointment to be rescheduled;Synsix may refuse or discontinue work where conditions are unsafe, unlawful or outside Synsix's authorized scope;gas Services must be performed in accordance with applicable safety and regulatory requirements;Products and equipment require ongoing Customer maintenance;Synsix cannot guarantee the future condition or performance of Customer-owned equipment;the Customer is responsible for providing accurate information relevant to the requested Service; andstatutory consumer rights and protections remain applicable wherever required by law.

STATUTORY RIGHTS

Nothing in these Terms is intended to exclude, waive, restrict or limit any right, remedy, warranty, cancellation right, disclosure requirement or protection that cannot legally be excluded, waived, restricted or limited under applicable Ontario or Canadian law.Where a provision of these Terms conflicts with a mandatory statutory requirement, the applicable law prevails to the extent of the conflict.

ORDER OF PRECEDENCE

If multiple documents apply to a transaction, the following order generally applies:Applicable law;Written amendments expressly accepted by the parties;Applicable quotation or Statement of Work;Applicable Service Schedule;These General Terms; andGeneral promotional or marketing materials.No contractual document may override mandatory legal requirements.
